The following Terms and Conditions of Service apply to all services provided by L&B Creative Design.

All work is carried out by L&B Creative Design on the understanding that the client has agreed to the terms and conditions.

Copyright is retained by L&B Creative Design on all design work including words, pictures, ideas, visuals and illustrations unless specifically released in writing and after all costs have been settled.

If a choice of designs is presented and one is chosen for your project, only that design is deemed to be given by L&B as fulfilling the contract. All other designs remain the property of L&B Creative Design, unless specifically agreed in writing.

PROJECT ACCEPTANCE

At the time of proposal, L&B Creative Design will provide the client with a written estimate or quotation by email.

Acceptance of the quotation binds the client to accept our terms and conditions.

These Terms and Conditions can be read at any time on the L&B Creative Design website.

DESIGN CHARGES

Charges for design services to be provided by L&B Creative Design will be set out in the written estimate or quotation that is provided to the client. Jobs are based on an hourly rate of £35 and a half an hourly rate of £20 unless otherwise stated or agreed.

SOURCE FILES

L&B Creative Design will supply proofs and PDF files as appropriate for printing, or other graphic files as detailed in the job scope or requested.

The release of copyright design source files, including but not restricted to INDD, PSD, AI, PNG or other source files; if the Client requires these files for transfer to an in-house or other designer, may be subject to a separate quotation.

CHARGES FOR ADDITIONAL SERVICES

Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will be added to the agreed quote and therefore change the final billing amount.

A new written estimate or quotation will be sent via email.

Again, acceptance of the quotation binds the client to accept our terms and conditions.

These Terms and Conditions can be read at any time on the L&B Creative Design website.

AMMENDMENTS

The client agrees that changes required over and above the estimated work, or in addition to the agreed scope, or where the client makes changes to the supplied copy or changes required to be carried out after acceptance of the draft design, will be liable to a separate charge.

PAYMENT

The client will be provided with a Proof Email, and an Invoice will be provided once all work is completed unless stated and agreed otherwise. At this time the amount due will become payable.

Any invoice queries must be submitted by email within 7 days of the invoice date.

All invoices are dated for 14 days once work is completed unless stated and agreed otherwise.

Payments may be made by online transfer. Payments made by cheque must be previously agreed and may be subject to an administration charge. Cheques should not be sent in regular mail unless sent recorded delivery. Returned cheques will incur an additional fee of £50 per returned cheque.

COPYRIGHTS AND TRADEMARKS

By supplying text, images and other data to L&B Creative Design for inclusion in the clients project, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client, or rightful copyright or trademark owner.

Any artwork, images, or text supplied and/or designed by L&B Creative Design on behalf of the client, will remain the property of L&B Creative Design and/or its suppliers unless otherwise agreed.

By supplying images, text, or any other data to L&B Creative Design, the client grants L&B Creative Design permission to use this material freely in the pursuit of the design.

Should L&B Creative Design, or the client supply an image, text, audio clip or any other file for use in their project believing it to be copyright and royalty free, which subsequently emerges to have such copyright or royalty usage limitations, the client will agree to allow L&B Creative Design to remove and/or replace the file within the project.

DATA FORMATS

The client agrees to L&B Creative Design’s definition of acceptable means of supplying data to the company.

Text is to be supplied to L&B Creative Design in electronic format as standard text (.txt), MS Word (.docx)  or via e-mail / or shared folder.

Images which are supplied in an electronic format are to be provided in a format as requested by L&B Creative Design via e-mail / or shared folder. Images must be of a quality suitable for use without any subsequent image processing, and L&B Creative Design will not be held responsible for any image quality which the client later deems to be unacceptable.

The client agrees to supply L&B Creative Design with all necessary materials, electronic, or otherwise, required to create and complete the project, and to supply them in a timely manner.

PROJECT DURATION

Any indication given by L&B Creative Design of a design project’s duration is to be considered by the client to be an estimation. L&B Creative Design cannot be held responsible for any project over-runs, whatever the cause. Estimated project duration should be deemed to be from the date that the quote was accepted by the client and all necessary information was received for the project to commence.

WEBSITES

L&B Creative Design require that a template be approved by the client before a complete design commences. Once the template(s) for the web site are approved by the client, further design work will commence.

Once web design is complete, L&B Creative Design will provide the customer with the opportunity to review the resulting work.

Once the clients website is live, L&B Creative Design are happy to provide said client with their own login access to their website. Any errors that may occur if the client chooses to amend their own website will be charged at an hourly rate of £35 to correct this. To minimise the risk of this happening, L&B Creative design strongly advice that all changed and amendments to the website are undertaken by L&B Creative Design themselves.

Website Maintenance Charges:

Amendments to Current Content – Free of Charge

Adding Additional Content to Current Pages – £20 per Item

Adding Additional Pages to Website – Hourly Charge of £35

WEBSITE HOSTING

L&B Creative Design offers a hosting services through an out-sourced virtual server. L&B Creative Design does not guarantee continuous service and will accept no liability for loss of service, whatever the cause, but will endeavour to fix errors if possible.

WE STRONGLY ADVISE that you use our current web hosting which comes at an annual fee. Whether you are already using another paid website host or are using a free site, we advise that you transfer your site to our host to ensure complete website security.

Website Set Up & Activation:

SSL Certificate Activation – £14.34* one off fee

Email Hosting Plan – £41.88* annual fee

Domain Name – £10* annual fee *average price

Website Hosting – £71.88* annual fee

DOMAIN REGISTRATION

L&B Creative Design cannot guarantee the availability of any domain name. Where L&B Creative Design is to register a domain name on behalf of a client it will endeavour to do so but the client should not assume a successful registration.

DESIGN CREDITS

The client agrees to allow L&B Creative Design to place a small credit and/or a link to L&B Creative Design own website on the customer’s website. This will usually be in the form of a small line of text placed towards the bottom of the page.

The client also agrees to allow L&B Creative Design to place websites and other designs, on L&B Creative Design’s own website for demonstration purposes and to use any designs in its own publicity and portfolios.

GENERAL

These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. L&B Creative Design reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.

ACCEPTANCE OF TERMS AND CONDITIONS

The placement of an order for design and/or any other services offered by L&B Creative Design, by email or in writing, is deemed to be acceptance of these terms and conditions, which are freely available at www.lb-creative-design.co.uk

An estimate validated by the client by email, constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the client and L&B Creative Design.
